Charlene 'anger' sparked attack

A woman launched an attack on the man she believed to be involved in the disappearance of teenager Charlene Downes.

Mother-of-one Emma Kinder, 23, hurled abuse at Iyad Albattikhi, Blackpool magistrates were told.

Kinder of Warbreck Drive, North Shore, Blackpool also spat at Mr Albattikhi.

She admitted threatening behaviour and assault but was cleared by magistrates of having a racial motive for her actions.

Don Green, prosecuting, said Kinder had been drinking at a Blackpool club. She then went to the former Funny Boyz takeaway on Dickson Road, now called Mr Beanz.

There she swore at a member of staff Nejed Yousef and Mr Albattikhi left his flat above the shop to see what was going on.

Kinder turned on him, swearing at him and saying she wanted to fight him. When she refused to leave police were called.

The prosecutor said: "When she was interviewed by police She said she was a good friend of the Downes family whose daughter has not been seen for years."

"She thought Mr Yousef was a member of the family she believed had killed Charlene and wanted to know why they were still running the takeaway."

Giving evidence, Mr Yousef said: "She was swearing at me using foul language. I told her to go home because I knew she had been drinking."

She referred to Charlene and said I was involved in killing her."

Blackpool teen Charlene disappeared in 2003. Mr Albattikhi stood trial at Preston Crown Court accused of her murder and was acquitted in 2008.

He told magistrates: "I used reasonable force to get her out of the shop. She was calling me bad names up to 15 times."

Kinder told the magistrates she had been drinking heavily and some part of what went on she could not remember.

David Charnley, defending, said that Kinder had lost her previous good character by her "unpleasant behaviour."

Kinder was given a 12 month conditional discharge and ordered to pay 200 in fines and costs which included 50 compensation to her victim for the spitting.
